How a claim for nursing home abuse works

Nursing home abuse and neglect can have serious consequences for victims and their families the most serious of which can be death. Fortunately, legal protections are available to help victims bring a claim for damages against a negligent nursing home for the damages they or their loved ones have suffered.

Nursing home abuse can occur in a variety of situations and can result when a nursing home negligently supervises staff; provides negligent care; negligently hires and retains staff; negligently maintains the premises; or negligently selects and maintains equipment at the facility. Nursing homes may be liable for the damages suffered by victims when they retain poorly qualified or inadequately trained staff; retain an inadequate number of staff; retain staff with a history of violence; or isolate residents.

Victims of nursing home abuse can suffer physical and psychological harm and damages in a nursing home or long-term care facility. This can also lead to victims being scared or embarrassed to report the

nursing home abuse they are suffering. A personal injury claim can be brought when the nursing home or staff has been negligent in the care they provide which resulted in harm to the victim. Victims may be able to recover compensation for their physical, financial and emotional injuries through a personal injury claim for damages.

Bringing a claim for damages can seem challenging, and there can be complexities related to who is liable or the elements of the claim, but it is an important legal protection to be familiar with that can serve as a crucial resource for victims and their families. Nursing home abuse should never occur but when it does, it is important that victims and their families are aware of the legal remedies available to them.
